By accessing or using Speakle, you agree to be bound by these Terms of Service.
2. Description of Service
Speakle is an AI-powered language learning platform.
3. User Accounts
You are responsible for maintaining the confidentiality of your account information. Users must be 18 years of age or older to create an account and use Speakle.
4. Subscription and Payments
We offer monthly and annual subscription plans. You will be charged at the beginning of each billing cycle. Flashcards and a limited set of conversation flows are available without a paid subscription.
5. Cancellation and Refund Policy
You can cancel your subscription at any time from account settings; access continues through the end of the paid billing period. If you are not satisfied, contact support@speakle.xyz and we will work with you on a refund.
6. Prohibited Conduct
Users must not:
• Violate any laws or regulations
• Impersonate any person or entity
• Interfere with the proper functioning of the service
• Use the service for any purpose other than language learning
• Attempt to bypass or "jailbreak" the AI tutor's intended functionality
• Engage in any activity that could harm, disable, overburden, or impair our servers or networks
• Use any robot, spider, or other automatic device to access the service
• Attempt to gain unauthorized access to any portion of the service or any other systems or networks connected to the service
• Submit any content that is unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene, or otherwise objectionable
• Use the service to generate, transmit, or store any content that is inappropriate, abusive, profane, or sexually explicit
• Attempt to use the service for any purpose that may be illegal or harmful
7. Intellectual Property
All content and materials available on Speakle are property of Speakle or its licensors.
8. Disclaimer of Warranties
Speakle is provided "as is" without any warranties.
9. Limitation of Liability
Speakle shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
10. Changes to Terms
We reserve the right to modify these terms at any time. Your continued use of Speakle after such changes constitutes acceptance of the new terms.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States of America, without regard to its conflict of law provisions.

13. Termination
We reserve the right to terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
14. Indemnification
You agree to indemnify and hold Speakle harmless from any claims, losses, liability, damages, and/or costs (including reasonable attorney fees) arising from your use of the service, violation of these Terms, or infringement of any intellectual property or other right of any person or entity.
15. Content Monitoring
While we do not actively monitor user content, we reserve the right to review and remove any content that violates these Terms or is otherwise objectionable.
16. User Content and Conduct
You are solely responsible for your conduct and any data, text, information, usernames, graphics, images, photos, profiles, audio and video clips, and links that you submit, post, and display on the service.
17. Liability for User Content
You acknowledge and agree that Speakle is not responsible for any user content and that you, not Speakle, are fully responsible for all content that you upload, post, email, transmit or otherwise make available via the service. You agree to indemnify and hold Speakle harmless from any claims resulting from any action taken by Speakle during or as a result of its investigations and from any actions taken as a consequence of investigations by either Speakle or law enforcement authorities.
18. Third-Party Services
You acknowledge that in using the service, your communications will be transmitted through third-party services, including but not limited to OpenAI. You agree that Speakle is not responsible for any interception, transmission, or misuse of your communications by any third party. Conversations with AI tutors are recorded and may be used to improve the service.
